These Terms of Use (“Terms”) govern your access to and use of the Fig Mobile App (“App”), an AI-powered website builder developed and operated by Fig Technology Inc. (“we,” “us,” or “our”).

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not accept these Terms in their entirety, you must refrain from using the App.

1. Eligibility and Account Responsibilities

To use the App, you must be at least 13 years of age. Users under 18 must obtain consent from a parent or legal guardian, who may be required to accept these Terms on their behalf. You are obligated to provide accurate, complete, and current information during account creation and to maintain the security of your account credentials. You bear full responsibility for all activities conducted under your account and must promptly notify us at socials@hellofig.io of any unauthorized access or security breaches. We are not liable for losses resulting from your failure to safeguard your account.

2. Subscription Services

We offer auto-renewable subscription plans on a monthly or annual basis, as detailed within the App. These subscriptions, including their titles, durations, and pricing, are processed through the Apple App Store. By subscribing, you authorize recurring payments, which will automatically renew until you cancel via your App Store account settings. Cancellation may be effected at any time; however, refunds for unused portions of a subscription period are not provided unless mandated by applicable law. We reserve the right to modify subscription pricing or terms, with prior notice provided through the App or email. Continued use following such changes constitutes acceptance of the revised terms.

3. Custom Domain Provision

Each premium account (monthly or annual subscription) includes one complimentary custom domain, subject to availability and governed by our Domain Policy, accessible within the App. You are solely responsible for ensuring your use of the domain complies with applicable laws and regulations, and we disclaim liability for any disputes arising from your domain usage.

4. Intellectual Property and Content

You retain ownership of all content you create using the App, such as websites, text, and images (“User Content”). By submitting User Content, you grant us a worldwide, royalty-free, non-exclusive, sublicensable license to host, store, process, and display such content solely to provide and operate the App’s services. You represent that your User Content does not infringe upon third-party rights or violate any laws. We may remove content that breaches these Terms. The App, including its AI technology and design, remains our intellectual property, protected by applicable copyright and trademark laws.

5. Termination and Modifications

We may update, suspend, or discontinue the App or your access thereto at our discretion, particularly if you violate these Terms. You may discontinue use at any time by uninstalling the App and canceling subscriptions. Provisions regarding intellectual property, liability, and privacy shall survive termination.

6. Disclaimer of Warranties and Limitation of Liability

The App is provided “as is” and “as available,” without warranties of any kind, express or implied, including fitness for a particular purpose. To the fullest extent permitted by law, our liability for any claims arising from your use of the App is limited to the amount you paid us in the preceding 12 months. We are not responsible for indirect, incidental, or consequential damages.
