Advertising Services Terms & Conditions

This Advertising Services Addendum (“Ads Terms”) supplements the Fig Technology Inc. Terms of Use. By enabling, configuring, or funding any advertising campaign within the Fig Mobile App (“the App”), you agree to be legally bound by these specific terms.
1. Scope of Service: Fig as a Technical Facilitator
Fig Technology Inc. provides a software platform that utilizes Artificial Intelligence to interface with third-party advertising networks, including but not limited to Google Ads (Alphabet Inc.) and Meta Ads (Meta Platforms, Inc.).
Not an Agency: Fig is a technology provider, not a digital marketing agency.
Authorized Agent Status: You hereby appoint Fig Technology Inc. as your limited authorized agent to manage bidding and payments on your behalf within these third-party platforms.
2. Billing and Funding of Ad Campaigns
Upfront Collection: To launch or maintain an active ad campaign, you must pay your chosen Ad Budget to Fig upfront. Fig collects these funds from you as a pass-through payment.
Disbursement to Networks: Upon receipt of your funds, Fig prepays or commits those funds to the respective ad networks (Google, Meta, etc.) on your behalf.
Budget Responsibility: You are solely responsible for the budget limits you set. Once a payment is processed, Fig immediately commits those funds to the third-party ad networks.
3. Strict No-Refund Policy
All advertising funds collected by Fig are strictly non-refundable.
Irrevocable Spend: Because Fig pays ad networks in advance to secure your placement, these funds cannot be recovered from Google or Meta once committed.
No Performance Refunds: We do not offer refunds based on the performance (clicks, leads, or sales) of an ad.
4. Absolute Disclaimer of Results (No Guarantees)
Fig Technology Inc. provides no warranty or guarantee regarding the success of your campaigns. Ad performance is subject to external market auctions, algorithm changes, and consumer behavior outside of Fig’s control.
5. Compliance and Content Responsibility
You are the "Publisher" of all ad content. You must review and approve all AI-generated ads. You agree to comply with Google Ads Policies and Meta Advertising Standards.
6. Limitation of Liability
Fig Technology Inc. shall not be liable for any "wasted" ad budget, accidental overspending due to user settings, or technical failures occurring on third-party platforms.
7. Termination and Account Deletion
Your responsibility for ad campaigns persists regardless of your account status with the App.
Active Campaigns Post-Deletion: If you delete your Fig account while an ad campaign is active and funded, the campaign will continue to run until the upfront budget is fully exhausted by the third-party ad networks.
User Responsibility to Pause: To stop ad delivery, you must manually "Pause" or "Stop" the campaign within the App prior to deleting your account.
8. Force Majeure (Events Outside Our Control)
Fig Technology Inc. shall not be held liable or responsible for any failure to perform, or delay in performance of, its obligations under these Terms caused by events outside our reasonable control ("Force Majeure Event").
Scope: Force Majeure Events include, but are not limited to: widespread internet outages, outages or technical failures of third-party platforms (Google Ads, Meta Ads, etc.), government actions, acts of God, strikes, or cyber-attacks.
Impact on Ads: If a Force Majeure Event occurs, your ads may stop running or display incorrectly. Fig is not obligated to refund any ad spend consumed or "lost" during such an event, as these conditions affect the entire advertising ecosystem and are beyond our technical influence.
