Fig Technology Inc. Terms of Use
These Terms of Use (“Terms”) govern your access to and use of the Fig Mobile App (“App”), an AI-powered website builder and marketing automation platform developed and operated by Fig Technology Inc. (“we,” “us,” or “our”).
By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not accept these Terms in their entirety, you must refrain from using the App.
1. Eligibility and Account Responsibilities
To use the App, you must be at least 13 years of age. Users under 18 must obtain consent from a parent or legal guardian, who may be required to accept these Terms on their behalf. You are obligated to provide accurate, complete, and current information during account creation and to maintain the security of your account credentials. You bear full responsibility for all activities conducted under your account and must promptly notify us at support@hellofig.io of any unauthorized access or security breaches. We are not liable for losses resulting from your failure to safeguard your account.
2. Subscription Services
We offer auto-renewable subscription plans on a monthly or annual basis, as detailed within the App. These subscriptions are processed through the Apple App Store or Google Play Store. By subscribing, you authorize recurring payments, which will automatically renew until you cancel via your device's account settings. Cancellation may be effected at any time; however, refunds for unused portions of a subscription period are not provided unless mandated by applicable law. We reserve the right to modify subscription pricing with prior notice. Continued use following such changes constitutes acceptance.
3. Marketing & Advertising Services (The "Agency" Clause)
By using the marketing automation features within the App, you appoint Fig Technology Inc. as your authorized agent to manage and deploy advertising campaigns on third-party platforms (including but not limited to Google Ads and Meta Ads) on your behalf.
Campaign Management: You authorize us to programmatically generate ad creatives (text and images), select targeting parameters, and manage bidding strategies based on the inputs you provide.
Ad Budgets: You are solely responsible for the daily or total ad budgets you set within the App. You acknowledge that ad spend is paid directly to the ad networks (Google/Meta) or processed through us as a pass-through cost, separate from your Fig App subscription fee.
Compliance: You agree that your business, website, and ad content comply with the advertising policies of Google and Meta. We are not responsible if your ad account is suspended, banned, or restricted by these third-party networks due to your business practices or content.
No Guarantee of Results: We do not guarantee specific results (e.g., sales, leads, or traffic volume) from advertising campaigns. Ad performance is subject to third-party algorithms and market conditions outside our control.
4. Custom Domain Provision
Each premium account includes one complimentary custom domain, subject to availability.
Ownership: You are the registered owner of the domain, but we act as the technical contact to facilitate registration.
Forfeiture: If your subscription is cancelled or unpaid, you may lose access to your custom domain unless you transfer it to a different registrar prior to cancellation.
Liability: You are solely responsible for ensuring your domain name does not infringe on third-party trademarks. We disclaim liability for any domain disputes.
5. Intellectual Property and AI Content
User Content: You retain ownership of all content you input into the App. By submitting content, you grant us a worldwide, royalty-free license to host, store, and process such content to provide the App’s services.
AI-Generated Content: The App utilizes Artificial Intelligence to generate website text, layouts, and ad copy. You acknowledge that AI systems may occasionally produce incorrect, offensive, or hallucinated information. You are solely responsible for reviewing, editing, and approving all AI-generated content before it is published to your website or live ad campaigns. Fig Technology Inc. is not liable for errors or inaccuracies in AI-generated output.
Our IP: The App’s underlying code, AI models, design, and branding remain our intellectual property.
6. Termination and Modifications
We may update, suspend, or discontinue the App or your access thereto at our discretion, particularly if you violate these Terms or if your account is flagged for suspicious activity by our third-party advertising partners.
7. Disclaimer of Warranties and Limitation of Liability
The App is provided “as is” and “as available,” without warranties of any kind.
General Liability: To the fullest extent permitted by law, our liability is limited to the amount you paid for the App subscription in the preceding 12 months. We are not liable for indirect, incidental, or consequential damages.
Advertising Liability: We expressly disclaim liability for any financial losses incurred through your advertising spend, including but not limited to "wasted" ad budget, accidental overspend due to user error, or lost revenue due to ad account suspensions.
8. Privacy and Amendments
Our Privacy Policy, linked within the App, outlines our data practices. We may amend these Terms periodically, with the updated version posted in the App. Your continued use post-amendment signifies consent.
9. Refund Policy
Subscription Refunds: Because payments are processed by Apple and Google, we generally cannot issue direct refunds for subscriptions. You must request refunds directly through the Apple App Store or Google Play Store support channels.
Domain Costs: Strictly No Refunds will be processed if a custom domain has already been purchased and provisioned for your account, as this represents a non-recoverable hard cost paid to the registrar.
Exceptions: For billing issues not related to the App Stores (e.g., direct ad spend charges), contact support@hellofig.io. Requests are evaluated on a case-by-case basis.
